Information may be voluntarily disclosed by others, or by you at your discretion when you make the choice to comment and leave feedback on her Facebook Pages, and/or when you choose to participate in her community groups on Facebook or HighLevel, as well as when you choose to share information or feedback in a blog comment, email, contact form, or video.

She does not sell, rent, or lease her subscription lists to third parties, and will not disclose your email address to any third parties except when it is required to assist in providing you with a service or product requested, to resolve a technical difficulty, or because she is legally required to do so to comply with the law, as would be the case for example if you were to report neglect, abuse, self-harm, or are a threat to yourself or others. Where possible, Jennifer will ask your permission before proceeding with contacting a third-party to intercede.
In compliance with the CAN-SPAM Act, all e-mails sent from Jennifer Ann Falandys will clearly state who the e-mail is from and provide clear information on how to contact the sender. 3 Months (90 Days) from the point when you are no longer receiving or have not taken steps to receive or enroll in a service or program, Jennifer will remove and delete any information she has about you that she has access to. If at any time during this period you want to resume services with her, you are welcome to do that. You can request that she erases or makes changes to any personal data she holds about you - Jennifer can change, delete, and provide you the information that she herself has access to as long as your request is made within 90 days and before the dissolvement process has begun. You can request to have a copy of the information that Jennifer has about you, which will include a copy of your intake form if one was created, and any contracts that were created as part of being provided a service, enrolling in a program, or receiving a product or materials from her.
Please keep in mind that this will take time, as Jennifer may have to submit requests to HighLevel to make sure that information is rectified or erased. Please email Jennifer at [email protected] if you'd like to submit this request. She will do her best to meet your needs and requests with what is within her reach. This does not include any data Jennifer is obliged to keep for administrative, legal, or security purposes. Including if a payment is due. If you have made a purchase from Jennifer Ann Falandys, your transaction data may be held by Paypal or Stripe and will be kept for tax purposes for the minimum amount of time necessary in the United States of America and in the State of New York, for a maximum period of 7 years or when it is no longer necessary to hold. This information is limited to your name, contact information, and your financial data related to the transactions you’ve made. Jennifer does not store or retain your credit card information.

DATA PROTECTION AND SECURITY
Jennifer seeks to protect Personal Data using appropriate and adequate measures based on the type of Personal Data and applicable processing activity. You need to prevent unauthorized access to your Account and Personal Data by selecting and protecting your password appropriately and limiting access to your device and browser by signing off after you have finished accessing your Account.
Jennifer seeks to ensure that user account information is kept private. However, she cannot 100% guarantee the security of your account and that your personal data will always be secure due to flaws in technology and security breaches that are beyond her control. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.
Email and instant messaging are not recognized as a secure medium of communication. For this reason, Jennifer Ann Falandys requests that you do not send private information to her through email, or instant messaging systems such as Facebook Messenger. Doing so is allowed but at your own risk.
SELLING AND RENTAL OF INFORMATION
Jennifer will not intentionally sell, trade, rent, or otherwise share information collected with the exception of the ways that have been outlined in this policy. Any merger decisions from HighLevel and the details that accompany that are beyond Jennifer's control.
HIGHLEVEL MERGER AND AQUISITION
In the event that High Level undergoes a business transaction such as a merger, acquisition by another company, or a sale of all or a portion of its assets, it’s important to note that user information is typically one of the transferred business assets. If High Level’s assets are acquired, or if they go out of business or enter bankruptcy, user information would typically be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of High Level and its assets may continue to use your Personal Data as set forth in this policy.
CALIFORNIA RESIDENTS
If you are a California resident, you can ask Jennifer to refrain from sharing your personal information with an affiliate or other third-party for marketing purposes. You can let Jennifer know your preferences by sending her an email at the address listed at the bottom of this document.

The right of access. You have the right to obtain access to your information (if we’re processing it), and certain other information (similar to that provided in this Privacy Policy). We usually act on requests and provides information free of charge but may charge a reasonable fee to cover the administrative costs of providing the information for baseless or excessive/repeated requests, or further copies of the same information. Alternatively, we may be entitled to refuse to act on the request.
Please consider your request responsibly before submitting it. We will respond as soon as we can. Generally, this will be within one month from when we receive your request but, if the request is going to take longer to deal with, we will come back to you and let you know.
