Your information, including Personal Information, may be stored through multiple points, which may be located in other countries. High Level relies on standard contractual clauses as part of its Data Processing Agreement. According to High Level, your Personal Data will only be collected and processed when there is a legal basis for doing so, as laid out in the GDPR. Survey and Poll Data: When you complete a survey, poll, or quiz prepared by Jennifer Ann Falandys, she collects the visitor’s responses to those that are required, such as first and last, name, and email address.  

Financial and Billing Information: (For Jennifer's Products and Services) If you purchase Jennifer Ann Falandys’ services, programs, products, or materials, you may have to enter your name, address, shipping information, and financial information such as your credit card number, the expiration date, and the CVV code on the back. This information is collected by a Third-Party Payment Processor & Controllers: Paypal which is also under Braintree, and Stripe. By submitting your billing and payment information, you are consenting to share this information with these third-party payment processors.  

Profile and Account Information: Jennifer stores some personal information you provide if you sign up for an account or create a profile on her website or within the third-party service such as High Level, which will house her CRM, and group communities, this may require the input of a username and password. Your profile data will not be shared without your consent unless it is necessary and in the good faith belief that such disclosure is necessary to take action to defend the safety of her users, protect the public, or defend her rights or property. If and where possible, Jennifer will discuss this with you to obtain your consent. Please be aware that you are responsible for your actions, conduct, and activities that occur under the username and password associated with your account. By using this website and its content, you agree to provide true and accurate information on the website and within the services provided to you on it. Never give your password to anyone. If you enter your username and password on her website, it is recommended that you log out before you leave and close your browser and reopen it before continuing to browse on the internet.  

User Information: This may include comments, and statements that you provide when visiting Jennifer’s website, groups, or social media platforms, any downloads of images, documents, or resources. Some personal data in this category is automatically collected, such as log files, time stamps, your IP address, your browser information, your internet service provider, your operating system, pages that you view, from what page you were referred to the website, the content that you engage with while you browse the website, carts that you have open. Jennifer may collect information about you that is publicly available. When visitors leave comments on the site that collects them, the comment and its metadata may be retained for a certain period of time so Jennifer can recognize and approve any posts, and follow-up to comments.

Information that you have entered into a contact form and a log of your consent to receive her newsletter are retained indefinitely until such time that you either unsubscribe from her newsletter or email list, request that a record of your subscriptions be provided to you or request that your data be erased. In some cases, Jennifer may be able to remove your personal data from an area like the comment section of a blog, but anywhere else, you will have to contact the third-party platform your information is posted on to submit that request. They will get back to you as to whether or not your request can be completed or why not. Where possible, Jennifer may be able to inquire about this on your behalf but cannot guarantee that she will have or be given access to that information or that the company will be able to completely erase your data based on its own unique internal framework. As these topics are part of the foundation and basis of her specializations, they are often integrated into the services, programs, products, and materials that she provides. They are also connected to outreach, how she grows her platforms, and expands upon her skillset, knowledge, and scope of her work. These topics are prevalent both inside and outside of confidential 1:1 sessions. These topics are discussed on her Facebook Pages, in her Community Groups on HighLevel and Facebook, and across the social media platforms that she is on that are accessible and viewable by other members and the public.

Please be mindful of what you choose to share on public facing websites, communities, and social media platforms. Information may be voluntarily disclosed by others, or by you at your discretion when you make the choice to comment and leave feedback on her Facebook Pages, and/or when you choose to participate in her community groups on Facebook or HighLevel, as well as when you choose to share information or feedback in a blog comment, email, contact form, or video.

You are free to decline to refrain from commenting, contacting her, or otherwise sharing any information related to these topics. Just because you provide information to Jennifer does not mean it will be used or processed.

When you use Jennifer Ann Falandys “Public Figure” Facebook Page, and/or Facebook Group, it is important to know that Facebook does use Cookies, which by their definition are used “to deliver relevant content and advertisements to you and measure and understand the effectiveness of our advertising” and upon creation of her Page, she was automatically provided with Facebook’s own Analytics tool “Facebook Insights” which is a condition of use that she does not have the choice to change. According to Facebook, Inc. when you visit her Page, a Cookie is deployed, each containing a user code, which is generated collected, and processed when the page opens. These Cookies, to the best of Jennifer’s knowledge, are stored, unless you adjust your Cookie settings on Facebook, and via your Browser. Through Facebook Insights, Jennifer does have access to view some aggregate data that her page that is part of Facebook’s natural design for their Pages, such as the number of likes, shares, the number of visits, clicks on links and how her tabs are used and may use this data to analyze usage patterns on her page, and within her group to improve her performance as a provider and to also improve upon page and group performance. She may have access to the country or location in which you are from, and your browser type when you visit her page or group which is listed under your username when you post to Facebook if you have “Location Services” enabled on your device, and none of the information described in this sentence is used by Jennifer. Via Facebook, Jennifer only has access to basic visitor statistics, that are not broken down and individualized. Facebook users, whether on Jennifer Ann Falandys’ page or in her group, are also subject to Facebook Inc.’s own Terms of Use, Data Policy, and Community Guideline Policy.

EMAIL POLICY

Jennifer Ann Falandys uses Google as her email provider which is utilized by the HighLevel platform to send out her newsletter and emails. Jennifer is committed to keeping your e-mail address confidential. She does not sell, rent, or lease her subscription lists to third parties, and will not disclose your email address to any third parties except when it is required to assist in providing you with a service or product requested, to resolve a technical difficulty, or because she is legally required to do so to comply with the law, as would be the case for example if you were to report neglect, abuse, self-harm, or are a threat to yourself or others. Where possible, Jennifer will ask your permission before proceeding with contacting a third-party to intercede. ​

In compliance with the CAN-SPAM Act, all e-mails sent from Jennifer Ann Falandys will clearly state who the e-mail is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from her mailing list so that you receive no further e-mail communication from Jennifer Ann Falandys.

Jennifer will retain the information that she has access to for the minimum amount of time necessary in order to ensure that she can provide you with the services you requested, respond to your questions, and make sure that the services, programs, products, or materials requested have been fulfilled and received.

3 Months (90 Days) from the point when you are no longer receiving or have not taken steps to receive or enroll in a service or program, Jennifer will remove and delete any information she has about you that she has access to. If at any time during this period you want to resume services with her, you are welcome to do that. ​​You can request that she erases or makes changes to any personal data she holds about you - ​Jennifer can change, delete, and provide you the information that she herself has access to as long as your request is made within 90 days and before the dissolvement process has begun. You can request to have a copy of the information that Jennifer has about you, which will include a copy of your intake form if one was created, and any contracts that were created as part of being provided a service, enrolling in a program, or receiving a product or materials from her.

Please keep in mind that this will take time, as Jennifer may have to submit requests to HighLevel to make sure that information is rectified or erased. Please email Jennifer at [email protected] if you'd like to submit this request. She will do her best to meet your needs and requests with what is within her reach. This does not include any data Jennifer is obliged to keep for administrative, legal, or security purposes. Including if a payment is due. If you have made a purchase from Jennifer Ann Falandys, your transaction data may be held by Paypal or Stripe and will be kept for tax purposes for the minimum amount of time necessary in the United States of America and in the State of New York, for a maximum period of 7 years or when it is no longer necessary to hold. This information is limited to your name, contact information, and your financial data related to the transactions you’ve made. Jennifer does not store or retain your credit card information.​

There are certain aspects of your data that may not be deleted, purely because Jennifer Ann Falandys does not have access to this data to completely ensure that it is completely removed and/or is restricted from deleting information that is part of the way a service operates and how it manages data beyond the accessible Site framework and its operating systems in relation to your user profile. DATA PROTECTION AND SECURITY

Jennifer seeks to protect Personal Data using appropriate and adequate measures based on the type of Personal Data and applicable processing activity. You need to prevent unauthorized access to your Account and Personal Data by selecting and protecting your password appropriately and limiting access to your device and browser by signing off after you have finished accessing your Account.

Jennifer seeks to ensure that user account information is kept private. However, she cannot 100% guarantee the security of your account and that your personal data will always be secure due to flaws in technology and security breaches that are beyond her control. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

Email and instant messaging are not recognized as a secure medium of communication. For this reason, Jennifer Ann Falandys requests that you do not send private information to her through email, or instant messaging systems such as Facebook Messenger. Doing so is allowed but at your own risk.

In the event that High Level undergoes a business transaction such as a merger, acquisition by another company, or a sale of all or a portion of its assets, it’s important to note that user information is typically one of the transferred business assets. If High Level’s assets are acquired, or if they go out of business or enter bankruptcy, user information would typically be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of High Level and its assets may continue to use your Personal Data as set forth in this policy.

CALIFORNIA RESIDENTS

The right of access. You have the right to obtain access to your information (if we’re processing it), and certain other information (similar to that provided in this Privacy Policy).
